The Taliban View of Islam and Governance: ‘We Do Not Accept This Anti-Islamic System Called Democracy’ – Part 3

O people of Pakistan! The laws relating to what is lawful and what is unlawful revealed from the heavens was transformed into Parliament. Alas! You should have feared God and have faith on Day of Judgment. You should not have misused the name of the holy Prophet (pbuh) to deceive the Pakistani people. You should have followed the Shariah of God and the holy Prophet (pbuh) instead of following in the footsteps of the British. But you crossed all limits. A woman became the ruler of an Islamic country. A Hindu Bhagwan Das was appointed as the Chief Justice. Is it still not the time for you to revert to the Shariah?  God has not given you any right to formulate laws. It is time you abstained from rebellion. Shun the anti-Islamic system called democracy and embrace caliphate. You want us to, God forbid, accept your rights of legislation and allow you to formulate legislations as per your wish because you are in majority. Indeed, your demand from us is that if we accept this constitution, you are ready to have a dialogue with us. In other words, we should compromise on our faith by recognizing your constitution.

“They want you to become infidels like you so that you become equals.”

Let it be clear, we have accepted the rule of Shariah from within. It is almost impossible for us to accept your constitution. You reject law of the Shariah, and we also cannot accept your shirk. (Polytheism)

“Are their such partners God for them who have formulated such laws for them which God did not approve, and if the Day of Judgment was not promised, their case would have been decided at once. Of course, there is painful torment for the tyrants.”

In Tafseer Ibn Kathir, Allam Ibn Katheer writes:

“These polytheists do not follow Deen but  what follow what their satans and elders order them to. They accept what their elders tell them about Halal and Haram.”

Here, polytheists are called those who deviated from Islam and got confused about Halal and Haram because of their own formulated laws. I am surprised that they recognized prostration before a grave a tree as shirk but they appear helpless in declaring the assignment of some powers of God to someone else shirk. Our stance is not different from our ancestors but a result of their efforts. By the holy Prophet (pbuh), a Muslim cannot follow Shariah until it is implemented because he has to live in the society and has deal with people. During this, he may have differences, or quarrels with them. And if it so happens, he will have to consult a judge, a jurist. If he adjudicates according to the Shariah, well and good but if there is no Islamic Shariah implemented then will he arbitrate the case of a Muslim according to the rules of Jahiliya? Listen to what the Quran says:

“Then is it the judgement of [the time of] ignorance they desire? But who is better than Allah in judgement for a people who are certain [in faith].”

Ibn Katheer writes in his exegesis:

“Here God chides one who turns his back on his clear ordainments that are based on virtues and prevents vices.  He abandoned the ordainments of God and followed the views and opinions of the men. He does not have any Shariah based argument in favour of them. He is very much like one of the Jahiliya who used to judge on the basis of his discretion and views in the same way the Tatars followed Yasiq  compiled by their ruler Genghis Khan.”

Yasiq is a compilation of principles taken from different religions. Some of the teachings are taken from Judaism, some from Christianity and some of them are based on the teachings of Islam. Many of the rules of the book are the product of their own personal ideas and desires. This compilation has assumed such a great status of a Shariah in the eyes of their children that they prefer it to the book of God and the Sunnah of the Prophet (pbuh). He further writes:

“So whoever does this is a kafir and fighting him is imperative until he reverts to the ordainments and teachings of God and the Prophet (pbuh) and accepts them as his arbiter in every issue concerning him whether big or small.”

Allama Ibn Katheer writes in Al Hadayah and Al Nahaya:

“All these laws are based on the opposition of the Shariah which God revealed to His prophets. Whoever renounced the clear Shariah of the final prophet (pbuh) and turned to the abrogated Shariah for guidance and judgment on issues concerning him is a kafir.”

Praise be to Allah...Imam Ibn Katheer explained this in such a wonderful way that I would say that he did a great favour to the people of Pakistan. When we reject the Constitution of 1973, some people say that there are some Islamic articles incorporated in it. Of course, there were some Islamic rules incorporated in the Yasiq of Genghis Khan also. The purpose behind my presentation of these arguments is to light the flame of freedom from the light of Islamic Shariah in the darkness of 64 years slavery.  By God, these slaves of the imperialists, our rulers have taken the lions of my nation from their dens to the holes of the wolves and want to force the lions to live in the holes. They are offering them lollypops and say that their fundamental rights will be protected there.

O tyrants! You infringed on the rights of God. How can then you give the rights of men? You will have the right to freedom of expression in the same way as they have given Dr Afiya and Salim Shahzad the right to expression.  The human rights will be protected in the same way as the rights of Munib and Mughees were protected in Sialkot. There rights will be protected as the rights of Hafiz Abdullah in Dera Ghazi Khan and of the Chechen sisters was protected in Akhrotabad.

O People! If you take the Quran to any court of Pakistan and say to the judge, “Please decide my case according to the Quran.” He will reject your plea as if he rejected the decisions of God, the ordainments of the Quran as the rulers have ridiculed Hudood Allah (the rules of God). They rejected the punishment of lashes and hand amputation by terming them barbaric. The Quran says:

“By God they cannot be Momin until they accept your decision in their mutual disputes. And when you deliver your judgment, they should not hesitate to accept your decision and accept them heartily.”

1) In Ahkam al Quran, Imam Abu Bakr writes:

“This verse testifies to the fact that if a person rejects even one judgement of the Prophet (pbuh) he is out of the fold of Islam even if he doubts the legitimacy of the decision.” (Ahkam al Quran v 3 p 118)

2. In his commentary of this verse, Allama Allosi writes:

“If someone says by way of objection why the Prophet (pbuh) did this? Or if he feels some kind detestation in his heart about a certain order of the prophet, he will be considered a kafir or Mushrik (polytheist) despite his good deeds and prayers.” (Tafseer Roohul Ma’ani vol 5 p 65)

The supreme Mufti of Pakistan, Mufti Md Shafi writes in his commentary of this verse:

“One who is not satisfied with the decision of the prophet (pbuh) on his case or dispute is not a Muslim. That’s why Hadhrat Umar killed the person who did not agree to the decision of the Prophet (pbuh) (Ma’arif al Quran vol 2 p 461)

Maulana Ashiq Ilahi Bulandshahri writes in Anwarul Bayan:

“One who does not accept the decision of the Prophet (pbuh) cannot be a Momin.” (Anwar ul Bayan Vol. 1 p 645)

Maulana Ashraf Ali Thanwi says:

“This verse proves that Iman is not completed until one does not accept the ordainments of God from the bottom of his heart without any reservations. The sign of acceptance from heart is that one tends to act on it immediately. And so if someone has displeasure or detestation in his heart, he cannot be a Momin.” (Nizam-e-Shariat- p261)

From these verses of the Quran and the arguments of the Ulema and exegetes some points became clear. Legislation is only the right of God and God alone whereas democracy assigns this right of God to the majority in the parliament. Therefore, this parliament and democratic institutions are the enemies of Islam.  The system existing in Pakistan is not only anti-Sharia but also an opponent of the Islamic Sharia and its enemy.

O people! I had asked you in the beginning what was the cause of all the anarchy, corruption and chaos in Pakistan. The only reason behind all this is that the system that God had created according to the human nature was rejected here. Obviously if you try to run a vehicle that runs on petrol with diesel, it will not run. We disowned the means of running the vehicle of humanity created by God and owned the system of Stalin and the laws of Europe, Britain, and America etc. How can then it be possible for us to get peace and comfort?

Remember, a drunkard gets addicted to wine; an adulterer gets temporary enjoyment from adultery and the lender also gets accustomed to usury. But how can a pious and righteous Muslim be happy with these dirt and filth. If America, Britain and their allies have been sticking to this system, it is because only gutter is the place for dirty insects. A person living in stench and filth is allergic to fragrance. But why should we waste a country that our forefathers obtained for Islam only. Why should we waste the fruits of the sacrifices of our elders? Was this country achieved only because Sir Zafarullah, Aiyub, Yahya, Bhutto, Musharraf, Zardari, Kayani and Gilani would be its rulers? What is the difference between them and Manmohan Singh? He is the custodian of the British system of government and they are also the slaves of the British system. Democracy rules there as well as here. What on earth did we change by achieving a separate country? The time for change has come. Now the pharaohs of our times will be challenged. The so-called Muslims who are the slaves of the imperialism will be caught by the collar and taken to task. O the people of Islam! The basic fight between Islam and Kufr is based on the difference of system. If a kafir does not accept Islam but accepts the Islamic system and agrees to live as a dhimmy, he is not only allowed to live in the Islamic sultanate but the total responsibility of the protection of his life, property and honour is with the Islamic government.
