False Terror Charges against Muslim Youths Cause of Concern: Union Law Minister

01 Jun 2016

Lucknow: Union Law minister Sadananda Gowda has expressed concern over rising instances of false terror charges slapped on Muslim youths in the country.

Gowda, who was in Aligarh at an event organised to mark two years of the Narendra Modi-led NDA government, said, "Arrests of Muslim youths on false terror charges are a matter of concern. We are thinking of bringing in changes. The law commission is working on a report in this matter to bring about reforms in criminal procedure, bail, prosecution lapses, etc." reports The Times of India.

The Union minister said reforms in the legal system are in the pipeline to solve this problem.

Gowda's remark on the issue has come days after Home Minister Rajnath Singh statement that there is no threat to India from the Islamic State as people of the Muslim community are against the terror organisation.

Recently, a Special Mumbai Court discharged all the Muslim men accused in the September 2006 Malegaon blast case despite NIA's opposition. Out of the 9 discharged, one is dead, six are out on bail and two are convicted in the Mumbai 7/11 train blast case.

UN: ISIL Using Hundreds of Families as Human Shields in Fallujah

June 1, 2016

TEHRAN (FNA)- The United Nations refugee agency said ISIL militants are holding several hundred families as “human shields” in city of Fallujah while government forces keep slicing through ISIL positions in the key Western city of Iraq.

United Nations High Commissioner for Refugees (UNHCR) said some 3700 people have fled Fallujah over the past week since the Iraqi army began its offensive on the city controlled by militant forces, Austrailian news website News.com reported.

“UNHCR has received reports of casualties among civilians in the city center of Fallujah due to heavy shelling, including seven members of one family on the 28th of May,” UNHCR spokesman William Spindler said.

“There are also reports of several hundred families being used as human shields by ISIL in the center of Fallujah.”

The accounts come from displaced people who have spoken to UNHCR field staff, spokeswoman Ariane Rummery said.

“Most people able to get out come from the outskirts of Fallujah. For some time militants have been controlling movements, we know civilians have been prevented from fleeing,” she said.

“There are also reports from people who left in recent days that they are being required to move with ISIL within Fallujah.”

ISIL militants fought back vigorously and parried an onslaught by the Iraqi army on a Southern district of Fallujah, officers said.

Iraqi authorities are holding some 500 men and boys under the age of 12 for “security screening” as they leave the city, a clearance process that can take up to seven days, Spindler said.

“But people are being released after this process and we understand that 27 men were released after being screened,” he said.

Man who moved LHC against JuD ‘Shariah court’ kidnapped, harassed

June 1st, 2016

LAHORE: A property dealer who had been pursuing litigation in the Lahore High Court against a religious organisation’s self-styled ‘Shariat Court’ was briefly kidnapped, intoxicated and threatened by two unidentified men on his way to the court on Tuesday.

“I was heading to the high court on my motorcycle when two bearded men intercepted me near Samanabad’s first roundabout. One of them took control of the bike, while the other sat behind me before heading towards Miani Sahib graveyard,” Khalid Saeed told this scribe in a weak voice, lying on a bed of Services Hospital’s emergency ward, with blood marks on his clothes.

A ‘Shariat Court’ established by Jamatud Dawa (JuD) had summoned Mr Saeed on the ‘complaint’ of his former partner in a property business, alleging misappropriation of his investment. Saeed had filed a writ petition in the LHC against the summons issued to him by the JuD ‘court’.

The court had heard the petition and directed provincial home secretary to look into the matter and decide it strictly in accordance with law after hearing version of the petitioner.

Mr Saeed filed an intra-court appeal against the order that was fixed for hearing before a division bench on Tuesday.

However, his counsel Advocate Maqbool Sheikh sought a short adjournment from the bench due to the incident.

Mr Saeed said the kidnappers forced him to drink a glass of juice before throwing him near the Ghazi Ilamuddin’s shrine in semi-conscious state.

“I could only called a friend for help before passing out,” Mr Saeed said, adding the duo kept threatening him of dire consequences if he did not withdraw the cases and reconcile the matter.

He was later shifted to the Services Hospital where doctors treated him in emergency ward. “We have washed his (Saeed’s) stomach and sent the samples of the retrieved fluid to laboratory for a detailed examination,” a doctor in the emergency ward said.

Personnel from the police-post at the hospital visited the victim and reported the incident to police station concerned.

Later a sub-inspector from Lyyton Road police station visited Saeed at the hospital and recorded his statement. He told the victim that the first information report (FIR) of the incident would be lodged after issuance of laboratory report of the sample.

Lahore DIG (operations) Dr Haider Ashraf said he was not aware of the incident yet and sought time for his official response. Later calls made to his mobile phone remained unanswered.

The Qazi (judge) of “Dar-ul-Qaza Sharia” established by the religious organisation had summoned Mr Saeed to it’s headquarters at Chauburji to defend himself against the allegations leveled in the complaint. However, the property dealer never obeyed the ‘order’ and instead approached the LHC for remedy.

The organisation had denied establishing any court, saying it offered arbitration only and resolved disputes in the light of Shariah.

It argues that offering arbitration to disputing parties was not illegal.

How the Media Is To Blame for Our Fear of India’s Muslims

May 31, 2016

In the recent past, videos of ISIS members allegedly of Indian origin were seen circulating on the digital platforms threatening India for its treatment of its Muslim population. It is a message to the ‘infidels’ of India by a few ‘believers’ of Indian-origin from a far-off land. What is remarkable in this entire saga is the way in which these videos have been interpreted and mediated by the ‘hypernationalist’ Indian media. The love-hate relationship between Indian mainstream media and ISIS is interesting and at the same time bizarre. Indian media has gone hyper with the videos of ISIS trying to provoke the audiences. Indian media left no stone unturned to imagine the scenario depicting what can possibly happen to this nation if these bloody people come here.

Pakistan’s Way of Fighting Militancy: Wait Until the War Comes Home

June 01, 2016

The death of Mullah Mansour, the Afghan Taliban’s former leader, on Pakistan’s soil has only earned more infamy and distrust for the country. Mansour’s demise came at a time when Pakistan was trying to convince the international world of its supposed genuine effort in pursuit of regional peace and stability.

For the last two years, the Pakistani military has made huge efforts to build the perception that it was finally abandoning the use of militant groups as a tool of domestic and foreign policy. On Pakistan’s part, the pretext of abandoning non-state actors doesn’t just end on the Afghan front; it has other regional and domestic contours, where state-level patronage continues.

Defending Pancasila to protect Indonesian pluralism

Wed, June 1 2016

The Constitutional Court asserted in 2009 that Pancasila was a foundation of the state that could not be amended. As a supreme source of law in Indonesia’s legal system, Pancasila, which was founded 70 years ago, consists of five supreme principles that must inspire all legal, economic, political and social developments, including the spirit of pluralism of this diverse nation.

Broadly speaking, Pancasila should form the basis for legal and human rights development in Indonesia and hence an accurate understanding of Pancasila’s five principles is a prerequisite to understanding the scope of protections under Indonesian pluralism.

The five principles are considered “supreme” because Pancasila is the philosophical basis for the founding of Indonesia. Apart from being the ideology of the nation, Pancasila serves as the highest source of law in the Indonesian legal system.

G25 opposes Hadi’s Bill, insists Malaysia is secular

1 JUN 2016

KUALA LUMPUR, June 1 ― G25 criticised today PAS president Datuk Seri Abdul Hadi Awang's private member's Bill to expand the range of punishments the Shariah courts can impose, saying hudud law is inappropriate in secular Malaysia.

The group of retired Malay senior civil servants also said the hudud Bill passed in Kelantan last year but has yet to be enforced, was unconstitutional as it violates Article 8 on equality before the law.

It pointed out that Muslims in the state governed by PAS would be subjected to two sets of laws: the Islamic and civil Penal Codes.

“We, in G25, categorically oppose Hadi's Bill and the Kelantan hudud Bill of 2015,” said G25 in a statement.

Bangladesh: All about Israel-Hating

Sebastian Bustle

June 1, 2016

Everyone shook hands and greeted each other courteously, but Aslam Chowdhury came under fire in Bangladesh after the photographs of the two men together were published on Safadi's Facebook page, and then picked up by Bangladeshi media. On May 15, police detectives arrested Chowdhury for alleged "involvement in a plot to oust the Bangladesh government with the support of Israeli intelligence Mossad."

Salah Uddin Shoaib Choudhury, a Bangladeshi journalist, was sentenced in 2014 to seven years in prison, allegedly for trying to travel to Israel, to speak on the rise of Islamic militancy in his country, and how madrassahs (Islamic religious schools) are being used to spawn militants.

Bangladesh has no diplomatic relations with Israel. It is a country where Jews and Israeli people are being cursed in every Friday sermon, from more than 250,000 mosques.

Why the election of London’s first Muslim mayor is a message of hope

Wednesday, Jun. 01, 2016

“I feel so proud of my city,” my interlocutor said, referring to the election of Sadiq Khan as London’s first Muslim mayor. She is Catholic, though she identifies first and foremost as British. But, like many other Londoners, she was inspired by Mr. Khan’s message of hope over fear.

Mr. Khan’s election contrasts sharply with dynamics that seem to be at work elsewhere in the West. European populations – in Hungary and Poland, and with a close call in Austria – are falling prey to increasingly radical, openly xenophobic populism. In the United States, Donald Trump’s bombastic bigotry has made him the presumptive Republican presidential nominee.

Londoners certainly had the option of intolerance.

In America, Domestic Extremists Are A Bigger Risk Than Foreign Terrorism

June 1, 2016

These are the messages that have defined the GOP presidential race. They have been used for the past eight years to justify obstruction of the Obama administration, and are now being used to paint the democratic candidates as dangerous. In the late stages of the GOP primary as the rhetoric became increasingly xenophobic, they were applied to increasingly broad swaths of the American population as well.

Years of constant repetition by members of the GOP have given them an appearance of legitimacy, now strengthened by Donald Trump’s victory in the GOP primary contest and the party’s growing embrace of him as their standard-bearer.
