Taliban Fatwa on Terrorism That Needs To Be Refuted: Attacking American Civilians in New York and Washington Lawful – Concluding Part 8

Editor’s Note: Some Muslims just love being in denial.They read newspapers, watch television, see the Taliban and other Jihadists perpetrating unspeakable horrors in the name of Islam, quoting verses from Quran all the time. But they refuse to see, even if pointed out, any connection between a certain intolerant interpretation of Islam and their dastardly conduct. This intolerant interpretation of Islam has been with us all through last 14 centuries of history, in one form or another, under one name or another. They were called khwarij orkharjis (seceders from Islam) then, and are called Wahhabis today, though themselves prefer to be called Salafis (believers in fundamentalist Islam as it was practiced by first few generations of Muslims) and muwahhids (strict believers in oneness of God). Their apologists in the media want them to be simply known as Muslims, so as to implicate all Muslims in their nefarious activities.

Muslims, aware of this game, however, want to disassociate themselves with Jihadi ideology and practice. Thankfully, Wahhabis are still a small minority sect, though they are gaining in influence with the massive injection of petrodollars in the propagation of their ideology in the last four decades. It is important that we mainstream Muslims keep exposing their ideology, highlighting and countering it so that the propagators and apologists of Wahhabism, Salafism and related ideologies like Ahl-e-Hadeesism, Qutubism, Maudoodism, Deobandism, etc, are not allowed to pose as mainstream Islam.

In view of this urgent need New Age Islam is reproducing an article from the Taliban mouthpiece Nawa-e-Afghan Jihad (July 2012). This is the 8th and the concluding part of this article in this monthly magazine explaining why Wahhabis believe that killing innocent civilians – men, women and children - among infidels (all non-Wahhabi Muslims, ex-Muslims and non-Muslims including ahl-e-Kitab) is permitted in their version of Islam. It is imperative for all mainstream Muslims to realize the real, murderous nature of Talibanism, and unequivocally denounce this ideology on the basis of Quran and Sunnah for the sake of world peace as much as for preserving the good name of Islam. Those Wahhabis who do not subscribe to these extremist ideas generated by the founder of this sect, Mohammad ibn-Abdul Wahhab and his ideological mentor Ibn-e-Taimiyya should disassociate themselves with the sect completely. If you are Wahhabi not because you appreciate the intolerance and extremism of this ideology but simply because you abhor visiting Sufi shrines and showing respect to the Sufi saints, you must understand that you don’t have to be a Wahhabi to abstain from vesting shrines. There are many non-sectarian Muslims or even Muslims belonging to other sects who do not visit shrines but are also not Wahhabis. Therefore, if it is possible to catch them without burning them in fire then it is unlawful to burn them because they come under the defeated people. If it is impossible to capture them without burning them then according to the majority of the jurists, it is lawful. This is also the stance taken by Imam Thuri and Imam Auzayi. Sayeed r.a. has quoted Safwan ibn Umar and Jarir r.a. with authentication that of course Janadah bin Umaiyah Al Azwi r.a, Abdullah bin Qais Al Fazazi r.a would burn the Romans by throwing fire on them and they would burn them in retaliation. Abdullah Bin Qais said that Muslims used to fight in this manner.

Allama Ibn Qudama said,

“This (opening the dams of rivers and lakes) is also lawful to drown the enemy though if it is possible to capture the enemy without resorting to this, it is not lawful if in doing so women and children also lose their lives as killing them intentionally is unlawful. But if capturing or defeating the enemy is impossible without doing so, then it is lawful in the same way as there is the risk of the loss of life of innocent people in nocturnal raids.”

In his commentary in Al Minhaj and Mughni Al Muhtaj, Imam Nawawi has said that laying siege to the fort and area of the infidels, releasing water on them and launching mortar attacks on them with the help of cannons is lawful.

Corroborating Imam Nawawi’s view, the author of Mufti Al Muhtaj said,

“In the same sense, it is lawful to stopping their water, releasing snake and scorpions on them even if the women and children are also mixed with the men, is lawful from the point of view of God’s ordainment “lay siege to them and capture them” (wa khuzuhum wa uhsiruhum)

It is mentioned in the Sahihain that of course the prophet (pbuh) laid siege to Taif. It is mentioned in Baihaqi and Sahihain that of course the prophet (pbuh) mounted cannon.  Therefore, by cannon all the weapons of mass destruction can be meant. Then he said that it is apparent from his statements that it is lawful to kill them with such weapons even if we can overpower them without actually defeating them.

The holy campanions and the prophet (pbuh) meted out this treatment to the enemy. It is mentioned in Sunan Sayid bin Mansoor r.a. that of course Janadah bin Umaiyah Al Azwi, Abdullah bin Qais Al Fazazi r.a. and their successors hurl fires (mortars) on the rulers of Bahrain. They also threw fire on the Roman enemies and this way both burned each other.

Abdullah bin Qais Al Fazrai narrates that they would attack the people in the sea during the reign of Hadhrat Amir Muawiyah. They hurl mortars on the enemy and the enemy also hurled fire on them. This way they would burn the enemy and the enemy would burn them. He said that the Muslims used to fight in this way.

The majority of the Ulema have said that it is lawful to burn the enemy, drown them in water, demolish their buildings, spreading poison and smoke in a situation when there is no distinction between combatants and non-combatants and it is not possible to capture or dominate them without resorting to these practices. But if it is possible to defeat or capture them then it is unlawful to resort to these practices or strategies. However, the Shafi’ites declare all these lawful whether it is possible or impossible to defeat them even without resorting to these. God knows best.

Therefore, given the arguments from Shariah, it can be said that whoever said that killing the Americans even in New York and Washington is unlawful actually shoots in the dark and he has said such a thing about which he does not have any knowledge. Killing the enemy by burning or drowning, destroying or damaging buildings to capture them or terrifying the enemy are the points on which the majority of scholars of Islam agree and was practiced and followed by the holy companions. How can then someone who is blind in the love of the Americans question something which is the authenticated by the Quran and the Hadith.
