Saudi Shariah Judges Decry Westernising ‘Stench’ Of Legal Reforms, Pushed By King Abdullah

RIYADH: Saudi judges who enforce Sharia have condemned what they see as “the stench of Western ideas” in sweeping legal reforms pushed by King Abdullah, underscoring friction between government modernisers and religious hardliners.
In a letter to Justice Minister Mohammed al-Issa seen by Reuters, eight judges complained about foreign trainers who shave their beards contrary to purist Islam, the minister’s meetings with diplomats of “infidel” states and plans to let women practise as lawyers. The authenticity of the letter, which did not directly criticise either the king or Issa, was confirmed by a source in the Justice Ministry who said it was sent late last month.
Saudi lawyers and political analysts say the judicial reforms announced by King Abdullah in 2007 and supported by Issa are needed to make the legal system more efficient and modern. “The system deters investors, who find the judiciary opaque. Outdated administrative procedures and inadequate judicial training remain problems,” the US embassy said in an assessment in 2009 revealed by WikiLeaks.
Since becoming de facto regent while he was crown prince in 1995, Abdullah has pursued cautious reforms aimed at modernising Saudi Arabia’s economy and making it more socially open, but he has often been blocked by powerful religious conservatives. The world’s top oil exporter has no written legal code or system of precedent, and judges determine cases based on their own interpretation of Sharia.
Lawyers say this means similar cases often yield starkly different verdicts and sentences. In some cases King Abdullah has stepped in to annul decisions seen as embarrassing to the country, such as the 2007 jailing of a rape victim on charges of consorting with unrelated men. However, the reforms have made scant progress five years after being announced, according to lawyers and the ministry source, a delay they blamed on conservatives in the Justice Ministry and within the judiciary.
“I think the majority of judges are in favour. They want to see development both as professionals and for society. But there’s another 30 percent. They fight (Issa) day and night, trying to slow down what he is doing,” said the ministry source. Issa, a former senior judge and top cleric but regarded as a moderate and one of the architects of the reforms, was appointed by King Abdullah in 2009 and tasked with accelerating the changes.
“It needs a lot of work to create these courts and I don’t believe they’re working as fast as we need. Commercial cases especially need things to be done quickly,” said Jassem al-Attiyah, a well-known lawyer. The plans entail setting up a supreme court, specialised criminal, commercial, labour and family courts and expanding the number of appeals courts as well as establishing a record of precedent to help guide lawyers and judges.
What for conservatives was more controversial was introducing non-Sharia training for judges and allowing them to use other schools of Islamic law besides the very strict one traditionally followed in the kingdom. In their letter to Issa, the judges said teachers at judicial schools were unqualified and complained about their unbearded appearance and habit of smoking cigarettes, characteristics frowned upon by very strict Muslims.
Earlier this year in a move intended to strengthen Issa’s position, King Abdullah appointed him to head the Supreme Judicial Council, which controls the judiciary, a position previously held by conservatives. In recent years the monarch has also sacked senior state-employed religious figures who publicly opposed reforms, including heads of the judiciary and morality police. “In an Islamic country if you lobby as Islamic you find a lot of supporters,” said the ministry source. “Commercial law is very difficult when you have a judge who doesn’t study principles of law but principles of religion.”

JEDDAH: Muslim NGOs have been urged to make their activities transparent to remove suspicions, establish better relations with governments and respond effectively to smear campaigns aimed at tarnishing their image.
“Deliberate attempts have been made to discredit Muslim NGOs and charities by linking them with extremism and terrorism. We should respond to these allegations in an intelligent and effective manner,” said Dr. Ismail Maritheri of King Abdulaziz University.
Giving a presentation on NGO Leadership at the community development workshop organized by the Islamic Development Bank, Maritheri emphasized the need to train students and community workers on how to respond to such allegations in a positive manner.
“We should respond to smear campaigns intelligently instead of reacting violently,” said Maritheri, an academic and trainer, who has obtained his doctoral degree in creativity.
Mohamed Rifai, who represents IDB Graduates Association in Sri Lanka, pointed out that some Muslim NGOs were accused of misappropriation and misuse of funds. “Funds collected for some charitable works are not fully utilized.”
Rifai called upon Muslim NGOs to learn from their counterparts in the US and Europe that work with a clear planning, and do their work silently without giving much publicity. “They have good links with the governments and communities and they are not suspected.”
At the same time, Muslim NGOs fight with one another and boast about their work. “They use most of their funds for building mosques and madrasas and neglect important community needs such as poverty alleviation, healthcare and education,” Rifai said.
Shehu Usman Muhammad Makarfi, chairman of the Shoura council at the National Islamic Center in Kaduna, urged Muslims to respond to anti-Islam campaigns in a civilized and Islamic manner. “We, Muslims, have to understand Islam properly and work according to its teachings without bothering about false allegations. We should learn how Prophet Muhammad (peace be upon him) dealt with such allegations,” he told Arab News.
Makarfi attributed the violent reactions to the anti-Islam film and cartoons to a lack of knowledge about Islam and Prophet Muhammad’s teachings. “We should start building Islam from our homes. Muslims should not be provoked hearing or seeing baseless allegations. We have to make use of such incidents as an opportunity to engage non-Muslims and enlighten them about the true teachings of our religion. This will change their attitude and make them realize that Muslims are not terrorists or radicals.”
In his hour-long presentation, Dr. Maritheri called upon the NGO representatives from different countries to achieve good leadership qualities to bring about changes and leave a big impact on their communities. “Negative thoughts and attitudes prevent us from unleashing our potentials.”
He also urged the delegates to spread the beauty of Islam in their communities. “Most people are not aware of the great teachings of Islam. Negative media has given a bad impression about this wonderful divine religion. We have to tell our non-Muslim friends the mental peace we enjoy by practicing Islam. We should also become the voice of the voiceless.”
Khalifa Said Jallo from Denver Colarado said the program impressed him. “It helped me to learn a lot from the experiences of others. It also gave me an opportunity to know more about IDB and its efforts for the development of Muslim countries and communities. Every organization faces problems but the success lies in how they overcome such problems.”

A Saudi official says a screen will separate genders on the Shura council but will allow women and men to communicate through internal communication network
A Saudi official says a screen will separate genders on the country's main advisory body to King Abdullah when women join it for the first time.
Following a decision by Abdullah, women will be allowed to join the Shura Council, his main group of advisers expected to reconvene early next year. The format is seen as a compromise with hardline Islamic factions that oppose even small reforms in the ultraconservative kingdom, where sex segregation is a widespread custom.
Abdullah has pledged to allow women to vote and run in the next municipal elections in 2015. But Saudi women still face many restrictions, including a ban on driving.
The official, quoted in Al-Watan newspaper on Wednesday, says an internal communications network will allow men and women to communicate despite the barrier.

Bahrain revokes citizenship of 31 Shia activists

DUBAI: Bahraini authorities have revoked the citizenship of 31 Shia activists, among them two former members of parliament, for having “undermined state security,” state news agency BNA reported Wednesday.
The names of the 31 activists, including brothers Jawad and Jalal Fairuz, both ex-MPs who represented the major Shia al Wefaq bloc, were listed in the report, which quoted an interior ministry statement.
Also named was Ali Mashaima, son of prominent activist Hassan Mashaima who is head of the Shia opposition movement Haq and who is serving a life sentence for allegedly plotting against the monarchy.
The government move comes after Bahrain late last month banned all protests and gatherings to ensure “security is maintained,” after clashes between Shia-led demonstrators and security forces in the Sunni-ruled country.
The Gulf state has experienced unrest since March last year when the authorities crushed protests led by the Shia Muslim majority.
According to the International Federation for Human Rights, 80 people have died in Bahrain since the violence erupted on February 14 last year.
Hundreds of people were arrested when the security forces, aided by troops from neighbouring Saudi Arabia, crushed the uprising within a month, while many activists, including some whose names appear on Wednesday’s list, were tried in special military courts set up at the time.
Another former MP and leading al Wefaq member, Matar Matar, told AFP that “many named (on the list) were acquitted by a military court” after being charged with harming state security.
Others named on the list are currently living abroad, according to opposition sources.
Tension has been running high in the kingdom following a spate of bombings on Monday in the capital Manama which killed two Asian expatriates. Four people have been arrested in connection with the bombings.
King Hamad ordered Tuesday “the swift arrest of the terrorists who carried out the recent terrorist acts in Bahrain” and urged citizens to help “bring them to justice so they receive their punishment over this appalling act.”

Syrian rebels kill 10 pro-Assad Palestinian militiamen

Syrian rebels killed 10 members of the Popular Front for the Liberation of Palestine-General Command (PFLP-GC), a faction loyal to President Bashar al-Assad, on Wednesday in clashes near a Palestinian camp in Damascus, opposition sources said.
Fighting between the two sides has escalated in the last few days in 'Street 30' and Hajar al-Aswad near Yarmouk, a camp inhabited by 150,000 Palestinians and as many Syrians. Syrian army artillery and warplanes have bombarded rebel positions in the area, the opposition sources said.

'Emirati chokes neighbour to death over barmaid'

Dubai: A drugged Emirati walking his pet monkey poured sand into his neighbour's mouth, choking him to death, in a dispute over a barmaid, a daily reported on its website today.
"A drugged-up man walking his monkey kicked his neighbour to the ground, bit his nose and poured sand into his mouth before leaving him to die in a dispute over a barmaid," The National daily said.

Mursi to make historic trip to Islamabad this month

ISLAMABAD: President Asif Ali Zardari and his Egyptian counterpart Mohamed Mursi are likely to hold bilateral talks on the sidelines of the upcoming Developing-8 (D-8) summit in Islamabad on November 22.
A D-8 charter is to be adopted at the summit along with an ‘Islamabad Declaration’, a highly-placed official source said. Significantly, the D-8 charter will put in place an approved policy framework for the group 15 years after its establishment in 1997 in Turkey.

Syrian rebels fire at Assad’s palace

AMMAN, Jordan: Syrian rebels fired mortars at President Bashar Assad’s palace in Damascus on Wednesday but missed, in an attack underlining the growing boldness of forces fighting to end his family’s 42 years in power.
Residents told Reuters the heavy-caliber shells hit a neighboring residential district that is home to members of Assad’s Alawite sect. State-run media said at least three people were killed and seven wounded in what it described as a “terrorist attack.”
Syria’s war, which has already spilled into neighboring Lebanon and threatened to spread instability in the Middle East, poses one of the greatest foreign policy challenges for US President Barack Obama as he starts his second term.

Syria Rebel Chief Says Escapes Assassination Bid

BEIRUT: The Syrian rebel commander in central Homs province, Colonel Kassem Saadeddine, said in a video posted on Wednesday that he had escaped an assassination attempt by forces loyal to President Bashar al-Assad.
“Thanks be to God, we have returned after having escaped from the hands of Assad’s bands,” Saadeddine, also the spokesman for the Joint Command of the Free Syrian Army (FSA), said in the video posted overnight.
In a statement with the video, the FSA Joint Command said Saadeddine had been ambushed by pro-regime militia forces, known as “shabiha” by the opposition, in an assassination attempt.
It said the colonel’s driver was lightly wounded in the attack, but no one among rebel forces was killed, and provided no further details.

PARIS — Making hip hop in Saudi Arabia is a bit of a tightrope act, says Qusai Kheder, self-styled ambassador for the genre who has built a niche following for his sex-and-violence free brand of rap music.
“Saudi Arabia is a very conservative country — that’s where we are from,” the 35-year-old said before performing to a crowd of mostly Arab, largely female, young fans at the Arab World Institute in Paris this month.
“This is our culture, our heritage, and we have reasons to respect it,” said the Riyadh-born young man in leather jacket, grey snood and clipped goatee, whose stage name is simply “Qusai”.

Palestinians hope for state in Obama second term

RAMALLAH, Palestinian Territories: Palestinian negotiator Saeb Erakat on Wednesday said he hoped that US President Barack Obama’s reelection would mean the creation of a Palestinian state in the next four years.
“We hope that a Palestinian state will be implemented in Obama’s next term,” he told AFP, without specifically welcoming Obama’s reelection.
Erakat pointed out that Israel had announced new settlement tenders as Americans were going to the polls on Tuesday, and called on Obama to take swift action to prevent continuing Israeli settlement activity.

Iran authorities said it executed 10 people convicted in drug trafficking prompted expressions of concern from human rights groups

Iran executed 10 drug traffickers in a prison in Tehran on Wednesday, a statement on the website of the prosecutor's office said.
The men sent to the gallows were convicted of trafficking "hundreds of kilos" (pounds) of narcotics, the statement said.

Israel mulls steps against the Palestinians over UN bid

Senior members of Israel's cabinet on Tuesday weighed punitive steps that could be taken against the Palestinians if they pursue a campaign to upgrade their status to "observer state" at the United Nations this month.
A senior Israeli official said Prime Minister Benjamin Netanyahu's inner circle of ministers reached an agreement in principle on the measures Israel may take if the Palestinians ask the UN General Assembly for the diplomatic upgrade.
The upgrade could grant the Palestinians, now registered as an "observer entity", access to bodies such as the International Criminal Court, where they could file complaints against Israel.

KARACHI: Two men belonging to the Pakistan Peoples Party (PPP) were killed when unidentified men opened fire on them at a restaurant in Orangi Town on Wednesday.
The men, identified as 23-year-olds Jahangir and Raza, were sitting in a restaurant when unidentified men opened fire on them, killing them instantly.
Both men were identified as Shia and belonging to the PPP.

3 Hazaras shot dead in Quetta

QUETTA: Three men of the Hazara Shia community were gunned down on the Spinny Road on Tuesday in continuing sectarian attacks in the city.
The shooting left two other members of the community, Hussain Ali and Muhammad Ali, injured. They were admitted to the Combined Military Hospital.
Police identified the deceased as Isa, Hasan Ali and Zaman.
They were in a taxi when attacked by the gunmen on motorbikes.
The killings sparked angry protests by members of the community who gathered on the Brewery Road, burnt tyres and raised slogans against the government and the Frontier Corps for their failure to prevent the killing of innocent people.

KARACHI: The stake of G4S – a global security solutions company operating in 125 countries – in Wackenhut Pakistan Private Limited (WPPL) has been bought out by its local partner, an official announcement said on Monday.
WPPL Chairman Ikram Sehgal, who already held 50% shares in the company, is now the sole owner of the security firm that employs over 11,000 personnel in the country.
On the face of it, a foreign company’s permanent exit from Pakistan is a bad thing. But the events that preceded the buyout tell a different story, according to Sehgal.

PESHAWAR: A blast targeting the vehicle of Assistant Superintendent Police (ASP) Investigations, Hilal Haider, in Qissa Khawani Bazar area of Peshawar killed six people and injured 36 others on Wednesday.
The ASP and his bodyguards were among those killed in the attack.
SP City Asif Iqbal while talking to media persons at the site of attack said that a suicide bomber struck the vehicle of ASP Hilal Haider adding that six to seven kilograms of explosives was used in the blast.

Asghar Khan case: FIA awaits detailed verdict to launch probe

ISLAMABAD: Top officials from the country’s Federal Investigation Agency (FIA) said on Tuesday that they cannot launch an investigation into accused politicians in the Asghar Khan case until a detailed verdict is announced.
Last month, the Supreme Court held two retired military generals, Director General ISI Lt Gen (retd) Asad Durrani and Chief of Army Staff Gen (retd) Aslam Baig, responsible for bribing politicians in order to rig the 1990 general elections.
The apex court had directed the FIA to probe charges against Baig and Durrani for rigging the elections as well as an investigation into the accused politicians who were allegedly bribed by the two generals.

NEW DELHI: Jamiat Ulama-i- Hind (JuH), the largest body of Muslim clerics, urged Islamic countries, including Saudi Arabia, to mount pressure on Myanmar for "cessation of attack" on Rohingya Muslims.
In a letter to the Islamic countries sent through their embassies in India, the JuH also sought an international probe into the violence in Myanmar in which thousands of Rohingyas were displaced.
JuH general secretary Maulana Mahmood Madani said, "The UN, in its report, counts the Rohingyas among the most persecuted stateless minorities in the world."

Punjab may export power to Pakistan

CHANDIGARH: Punjab deputy chief minister Sukhbir Singh Badal, who is on a visit to Pakistan, on Tuesday said the state would be in a position to export electricity as it was going to become power surplus soon. However, Badal junior added that power export to Pakistan would depend upon an approval from the government of India.

British envoy writes to J&K CM, says UK will revoke travel advisory

NEW DELHI: British high commissioner to India Sir James Bevan has written to Jammu & Kashmir chief minister Omar Abdullah, saying that the UK government will shortly announce the revocation of the advisory against its citizens travelling to the state.
The UK will be the third major country to revoke such an advisory after Japan and Germany. It is seen as an international recognition of the all-time drop in terror activities in the state. The government hopes that the move will further boost the J&K's tourist industry, the mainstay of its economy.

Lucknow: In an overcast afternoon, in the narrow lanes of old Lucknow’s Thakurganj area, locals — brandishing brooms and assisted by a few persons from a trust — were seen frantically washing a two-grave cemetery, ensuring the place is spotless.
The epitaph on the larger grave reads Begum Akhtar and, it is after 38 years that people have turned towards her once again, restoring her resting place which lay in utter neglect till now. NEW DELHI: Hizbul Mujahideen chief Syed Salahuddin has unwittingly become an obstacle in India's fight against left wing extremism. Salahuddin's threat of more attacks on sarpanches and panches in Jammu and Kashmir has delayed fresh deployment of as many as 6,000 troops for anti-Naxal operations in Maoist-hit areas across the country.
The home ministry had asked the Central Reserve Police Force (CRPF) to deploy 10,000 additional troops in Naxal-hit areas for an intensified operation in the coming months. These troops, to be deployed before March next year, were to come from a mix of fresh recruits and those deployed in the Valley, given that the government has already embarked on a process of de-escalation of forces in the state.

Police arrested three members of Islamist outfit Hizb-ut Tawhid in Panchagarh town yesterday and seized leaflets, posters, CDs and books on jihad from their possession.
The arrestees are Hozaifa Islam, 14, Zahid Islam, 20, and Sajid Hasan, 17. They hail from Gangni upazila of Meherpur district.
They had been living in a rented house in Tulardanga area of the district for the last one month, police said.
The Hizb-ut-men were distributing books on jihad and CDs among the locals and pasting posters on walls in front of the local press club at around 1:00pm.
Being informed by local people, law enforcers from Panchagarh Police Station reached the spot and arrested the Hizb-ut-Tawhid activists.

One of the few things that Obama and Republican candidate Mitt Romney agreed on during their bitter campaign was that US combat troops would pull out by the end of 2014, whatever the state of the conflict against Taliban insurgents.

DHAKA: Around 100 people are missing after a boat carrying Rohingya refugees sank off Bangladesh as it headed to Malaysia early on Wednesday, coastguard officials said.
Bangladesh Border Guard commander Lieutenant Colonel Zahid Hasan said the vessel was carrying around 110 passengers when it went down off the southwestern Cox's Bazaar coastal district. David Cameron meets Syrian refugees as UK begins rebel talks

David Cameron says he is determined to give Syria a brighter future as he met refugees of the conflict at a camp on the Syrian-Jordanian border.
Britain is to begin talks with armed Syrian rebels in a bid to unite the opposition to President Bashar al-Assad, the UK prime minister said.
The discussions are due to take place in Jordan and Turkey.
Visiting the refugee camp on Wednesday, Mr Cameron said the suffering of refugees was "horrendous".
