Bareilly:
Tauqeer Raza Khan, a prominent scholar and founder of Ittehad-e-Millat Council,
appealed to Muslims across the state to gather in large numbers at the Islamia
School ground in Bareilly on January 7 for a "mass sacrifice" in
protest against recent hate speeches made at a religious conclave in Haridwar.
During
a press conference on Saturday, Khan said, “There have been many incidents even
before the recent Dharam Sansad against which objections were raised by our
community. However, the present government was never ready to hear anything.
Our ulemas conducted three meetings but we never called it Dharam Sansad. The
kind of language used at the recent Dharam Sansad can never be used by our
ulemas. Our ulemas show the path of peace, patriotism and love to disciples."
The
religious scholar further said, “It is really shameful that such a situation
exists in our country now. They want to kill 20 lakh Muslims. So, we decided
that we are ready for it. I urge the government that they can send their people
to kill us. On January 7, at least 20,000 Muslims will surrender before them.
The best way is that Muslims sacrifice their lives to ensure peace in the
country."
He
added, "From now on, we will gather in large numbers every Friday. Let the
world see what India’s Muslims are going through at the moment.”
Meanwhile,
police have refused to grant permission to hold such a protest gathering in
Bareilly.

About
30 headstones at a Muslim cemetery in the northwestern German city of Iserlohn
have been damaged, police said Saturday.
The
incident occurred late Friday or early Saturday, according to a statement by
prosecutors and the Hagen police department. Authorities issued an appeal for
information from anyone who witnessed the vandalism or has information that
could help the investigation.
It
said the attack on New Year's Eve is "a new indicator of sick Islamophobic
mentality which has been on rise especially in Europe and even targets Muslim
cemeteries."
The
ministry urged officials to find the "perpetrators of this disastrous
attack" and that they are "brought to justice and given the
punishment they deserve."
According
to a recently published "European Islamophobia Report 2020," a total of
901 Islamophobic crimes were registered by the Federal Criminal Police Office
in Germany in 2020.
Furthermore,
2020 saw a rise in online Islamophobia as coronavirus lockdowns were imposed
and life shut down across Europe, according to the report.

SOME
Muslim Filipinos also celebrate New Year but merely as a social obligation or
pakikisama.
What
makes this New Year's Day unique is that according to the Muslim calendar, each
day begins at sunset with the New Year itself ushered in by the first sighting
of the moon.
On
Friday, before the clock struck midnight, the majority of Filipinos were
waiting for the New Year countdown with much excitement as the first day of the
Gregorian calendar, Jan. 1, 2022 or Jumada Al-Awwal 27, 1443 in the Muslim
calendar known as Hijra began.
Awal
means beginning in English, and Muharram is the name of the first month in the
Muslim calendar. The first day of Muharram is, therefore, the Islamic New
Year's Day, and on this date, the commemoration of Hijra or the historic
journey from Mecca to Medina begins.
Hence,
some Muslim religious scholars are of the belief that it is not permissible for
a Muslim to celebrate the New Year, a Christian tradition, considering that
they have their own New Year, known as the Amun Jadid.
In
an exclusive interview with the Chairman of the Imam Council of the
Philippines, which is akin to the Catholic Bishops' Conference of the
Philippines or CBCP, Aleem Said Ahmad Basher told The Manila Times that Muslim
Filipinos in particular may celebrate the New Year as part of their social
obligation but not as a religious compliance.
"The
New Year that was celebrated last night by all people throughout the world,
including the Philippines, could be part of a social obligation but not a religious
duty. Nowhere is it mentioned in the Holy Qur'an or the Hadith or sayings of
Prophet Mohammad that Muslims are enjoined to celebrate New Year," Aleem
Basher noted.
Basher,
a graduate of Kolliyatu Da'wah from the College of Islamic Propagation in Al-Azhar
University in Cairo, Egypt, explained that Islam is a religion of peace,
tolerance, harmony and humanity where its followers are enjoined to perform
three duties: to God, to one's self and to others.
Hence,
if there were some Muslim Filipinos who celebrated the New Year last night, in
the same manner they celebrate their own Amun Jadid New Year. Just like the
Filipino Chinese celebrating not only their Chinese New Year, they were just
showing respect or pakisama with their non-Muslim neighbors.
Hence,
the Islamic New Year is on the first day of Muharram, the first month in the
lunar Islamic calendar, which differs from the Gregorian calendar.
Basher
said since the Islamic calendar is based on the lunar month, which is roughly
29 days, it usually ends up being about 11 days shorter than the Western
calendar.
In
as much as the Western calendar is based on an Earth year, its months are
divided somewhat arbitrarily, and February is a month with an irregular number
of days.
By
contrast, the Islamic year is 354 or 355 days long based on the moon's cycle,
and each month is either 29 or 30 days long, Aleem Basher further explained.
One
of the basic principles of Islam is "Islamic ethics," which is
described and emphasized in many Quranic verses and sayings of the Blessed
Prophet Muhammad (PUBH).
He
said Islamic morals teach Muslims to "treat [people] kindly and
justly" no matter where they are from or what they believe in as long as
they do not fight against them.
While
Islam ordains Muslims to treat all people without discrimination except those
who are hostile to Islam, it also urges Muslims to "take care in their
relations with non-Muslims in order not to weaken in their Islamic belief,
consciousness and identity."
Basher,
who hails from the Islamic City of Marawi, said under the belief of Islamic
teachings, a person who has accepted the basic tenets of Islam will be weakened
if he celebrated Christmas too.
Other
Muslim religious scholars agreed that a Muslim performing an action of another
religion willingly is committing blasphemy.

The
Islamic Emirate said that the recognition of the current Afghan government was
nevessary for the world itself, not only for Afghanistan.
The
Islamic Emirate made the remarks in response to comments from representatives
of regional countries, which demanded reforms in the Afghan government for
recognition.
Russian
Foreign Minister Sergey Lavrov said that the official recognition of the
“Taliban” depends on progress in fulfilling their promises.
“The
issue of official recognition of the Taliban authorities is premature for the
time being. The positive decision will depend on evolvement of developments in
Afghanistan, to be more specific - when the Taliban will fulfill their
promises, including the establishment of the inclusive government, and
efficient combating of terrorist and drug threats coming from the territory of
Afghanistan,” Lavrov told Russian news outlet TASS.
“We
will gradually move together with other members of the global community in
linkage to that towards exclusion of the Taliban from sanction lists of the UN
Security Council, which will create in its turn the basis for official
recognition of the new government of Afghanistan,” Lavrov added.
“An
inclusive government is one of the needs for Afghanistan's political society.
If the Islamic Emirate seeks good governance and an enduring authority, they
should pay attention to this issue,” said Hekmatullah Mirzad, a university
instructor.
“The
recognition of the Islamic Emirate was not only the need of the Islamic Emirate
but the international community as well. Afghanistan is a member of the
international community and the engagement of Afghanistan with the
international community benefits all of us,” said Inamullah Samangani, deputy
spokesman for the Islamic Emirate.
The
Islamic Emirate cited engagement with the world and self-sufficiency as its
core policy for the year 2022.

Court Nixes Punishment For Manslaughter, Says Guilt Is Still Intact

KARACHI:
A model court has ruled that an accused can evade punishment following an
out-of-court settlement in a manslaughter case but his guilt will remain intact.
The
ruling was given by Additional District and Sessions Judge Liaqat Ali Khoso of
the Model Criminal Trial Court (Central) in his judgement in a case pertaining
to the death of two labourers in a boiler blast in a pharmaceutical company in
Federal B. Industrial Area in 2018.
Talking
to Dawn, former Sindh High Court Bar Association president Barrister Salahuddin
Ahmed explained that an accused would neither be jailed or fined or face any
other penalty by the court, but he/she will always be considered as a convict.
He
elaborated that such an accused would have to face legal consequences. “Such as
he/she cannot run for election, hold a public office or will not be considered
as ‘never convicted’ wherever it is necessarily required to be mentioned in the
documentation.”
Farhan
Khan, the owner of Reign Nutro Pharma, was booked under Sections 322
(qatl-bis-sabab or manslaughter), 319 (qatl-i-khata), 426 (punishment for
mischief) and 427 (mischief causing damage to the amount of fifty rupees) of
the Pakistan Penal Code.
The
matter came up for hearing recently when legal heirs of victim Ghulam Ishaq
pardoned the accused “without accepting Diyat (blood money) or any other sort
of monetary compensation”.
They
also filed an application under Section 435(6) of the criminal procedure code,
which was also supported by their personal affidavits raising no objection if
the accused was acquitted by way of a compromise between them and him.
However,
the legal heirs of second victim Imran Naseem also filed a compromise application
with certain terms and conditions, agreed between his widow and the accused.
Under
the terms and conditions, the accused will pay Rs20,000 per month until the
second child of the deceased will attain the age of 20 years without
fail/default and deposit the said amount with the court’s nazir (official).
The
judge noted that the parties entered into an out-of-court compromise. However,
they waived of all other payments like diyat (blood money) etc.
State
prosecutor Shakeel Ahmed conceded to the compromise applications filed by the
legal heirs of both the victims stating that they had settled the matter
outside the court and the main purpose of law was to maintain public peace and
tranquillity. Therefore, the legal heirs had no objection, he stated.
The
judge noted: “Court can accept the compromise at any stage of the case, the
legal heirs have forgiven the accused person in the name of Almighty Allah, and
there is no legal impediment to accept the compromise arrived between the
parties in such circumstances of this particular case.
“As
per section 345 (6) CrPC the compounding of offence shall have the effect of
acquittal. The proposition held in the provisions of above referred section of
CrPC of 1898 does not mean that accused is acquitted but the composition of an
offence shall have the effect of an acquittal.
“It
means the guilt of the accused shall never be bolt out. It is sufficient for an
accused to benefit by vanishing and avoiding punishment provided by the law.
The guilt of the accused shall have effective in the field in the life time of
accused. In the case of Waheed Ahmed in Criminal Appeal No. 328 of 2012 (appeal
against conviction) along with Criminal Miscellaneous application No:185/2017
(compromise application) it was discussed by his lordship Justice Qazi Faiz
Essa that guilt of accused would not be bolt out however, it is sufficient for
accused to escape punishment for the offence by way of compromise,” the judge
stated.
“There
is no specific word in any provision of PPC and CrPC that the conviction of an
accused is set aside by way of a compromise application which was effectively
made between parties. The legal heirs have right to waive their right of Qisas
but they have no right to take away the authority of state in awarding punishment
to the accused as Taze’r. Same proposition is held in section 311 PPC.
“The
proposition of section 311 PPC supports that a compromise does not vanish the
guilt of accused as the said section authorized the court/state to award the
accused a punishment as Taze’r, which may be upto sentence of death as Taze’r,
though the compromise might have been accepted and death as Qisas has been
taken away from the accused but yet he may be awarded death sentence as Ta’zir.
“In
view of the above facts and circumstances and legal position, both applications
moved by legal heirs of above named deceased are accepted. Accused Farhan Khan
extended effect of acquittal by way of compromise under section 345 (6) CrPC
suffice for him to skip from punishment due to compromise; however his guilt
shall not be bolted out by way of compromise,” the judge ruled.
Supporting
the judgement, Barrister Ahmed was of the opinion an accused may escape the
punishment, but he his conviction must be considered in black and white for
future for the purpose of deterrence in the society.

clean the streets following New Year celebrations.

street clean follows other initiatives this winter, including visiting children’s

Muslim Youth Association Bolton celebrated by being up at the crack of dawn to
show their gratitude for a successful 2021 and to earn blessings with a
prosperous 2022 that will allow them to continue to contribute to and serve
their local communities.
Youth
leader for Bolton Umair Ahmed said: "Our members have enjoyed living in
Bolton for decades and so any opportunity to help our local community is a much
welcomed one."
He
added: "Cleaning the streets of Bolton also presents us with an
opportunity to become better Muslims as cleanliness is an integral part of our

lockdowns must be the “last resort,” even as England witnesses a record number

Jan 2 — Incoming Deputy Chief Minister Datuk Sri Dr Sim Kui Hian said on New
Year’s Day that the Ministry of Health (MoH) plans to inoculate children aged
from three to 11 next month to protect this age group against Covid-19.
“The
vaccine to be used will be Pfizer-BioNTech, but the dose to be given will be
different than that for adults. The dose for these children will be less,” he
said during Kuching South Mayor Datuk Wee Hong Seng’s weekly Facebook live
‘Shall Wee Talk?’ yesterday.

Jan 2 — A total of 144,440 individuals or 72.95 per cent of the adult
population in Sibu Division have received their booster dose, said Nangka
assemblyman Dr Annuar Rapaee.
Not
resting on his laurels, the incoming Assistant Minister For Education,
Innovation and Talent Development I (Education and Innovation), said mobile
vaccination drive will be reactivated to ensure more people receive their
booster jabs.
“We
will roll out mobile vaccination drive again as we want more people in the
division receive their booster jabs as part of the efforts to further reduce
the number of daily Covid-19 infections,” Dr Annuar said in his Facebook live
session last night to update on the Covid-19 situation here.

says more than 28,500 children have been killed in Afghanistan over the past 16
years.
“Afghanistan,
for example, has the highest number of verified child casualties since 2005, at
more than 28,500 – accounting for 27 percent of all verified child casualties
globally,” UNICEF Executive Director Henrietta Fore said in a statement on
Friday.
Afghanistan,
Yemen, Syria and northern Ethiopia are the places where children have paid a
devastating price amid armed conflict and lingering insecurity, according to
UNICEF. “Year after year, parties to conflict continue to demonstrate a
dreadful disregard for the rights and wellbeing of children,” said Fore. He
called on “all parties to conflict” to take concrete measures to protect
children who “are suffering, and children are dying because of this
callousness.”

Court (IHC) on Saturday seeking the modification of an order passed in
connection with the contempt of court proceedings over an affidavit of former
chief judge of Gilgit-Baltistan Rana Mohammad Shamim.

Abbasi pointed out that the order passed by IHC Chief Justice Athar Minallah
stated: “They (Ansar Abbasi and Aamir Ghouri) were explicitly asked whether
they would report and publish the copy of a leaded document in the form of an
affidavit if it contained untrue facts intended to influence the outcome of
pending judicial proceeding. They answered that they would do so if it was in
the public interest because their role was of a mere ‘messenger’.”
