Ranchi: The Jharkhand High Court, referring to Muslim
Personal Law, has said that Muslim girls aged 15 or above have the liberty to
marry the person of their choice without any interference of their guardians.
The court said this while quashing criminal
proceedings based on an FIR lodged against a Muslim youth who married a 15 year
old girl of his community.
In the FIR, Mohd. Sonu, 24, a resident of Nawada in
Bihar, was accused of coaxing a 15-year-old Muslim girl of Jugsalai in
Jamshedpur’s Jharkhand, to marry him.
Sonu challenged the criminal proceedings based on the
FIR — filed by the girl’s father, and approached the Jharkhand High Court with
a quash petition.
However, during the hearing, the girl’s father
submitted that he was not opposed to the marriage. Thanking Allah “for
arranging a suitable match” for his daughter, the man said he filed an FIR
against Sonu “due to some misunderstanding”.
In fact, the lawyer representing the girl’s family
also told the court that both the families have accepted the marriage.
After hearing both the parties, Justice Dwivedi
ordered cancelling the FIR and criminal proceedings against Sonu.
The High Court in its verdict, made available on
Wednesday, said matters related to marriage of Muslim girls are governed by the
Muslim Personal Law Board, adding in context of this particular case that the
girl is 15 years old, and she is free to marry the person of her choice.

Iran has arrested a third female journalist from the
reformist newspaper Shargh against the backdrop of nationwide protests sparked
by Mahsa Amini's death, the daily said Wednesday.
The security forces arrested Nastaran Farokheh at her
home on Sunday and confiscated her laptop and phone, as well as the phones of
her family members, Shargh said on its website.
“The reason for the arrest is not yet clear,” it said.
Iran has been gripped by protests that erupted when
Amini, 22, died in custody on September 16 after her arrest for an alleged
breach of Iran's strict dress code for women.

Farokheh's arrest is the third of a female journalist
from Shargh newspaper since the protests broke out.
The first, Niloufar Hamedi, was arrested on September
20 after she visited the hospital where Amini spent three days in a coma before
her death.
Hamedi was charged on November 8 along with another
female journalist, Elaheh Mohammadi of Ham Mihan newspaper, with propaganda
against the state and conspiring against national security.
The second female journalist at Shargh to be arrested
was Marzieh Amiri, who was detained on November 1, the newspaper said.
Mohammadi was taken into custody on September 29 after
she travelled to Amini's hometown of Saqez in Kurdistan province to cover her
funeral.
The reformist newspaper Sazandegi reported in late
October that more than 20 journalists were being held for their reporting of
Amini's death or the subsequent unrest.
The business newspaper Jahan-e Sanat was closed down
last week after accusations were made against the security forces, the
judiciary said.
On October 30, more than 300 journalists issued a
joint statement criticizing the detention of their colleagues and the denial of
their rights, including access to lawyers.

French Court Fines Restaurant Owner For Banning Muslim

A French court fined a restaurant owner in southwest
France for prohibiting the entry of a Muslim woman for wearing the Islamic
headscarf (also known as the hijab).
The court in the city of Bayonne in the Basque region
ruled that the 64-year-old female restaurant owner was guilty of discrimination
based on religion for asking the customer to remove her headscarf.
The incident took place on Mother’s Day in July, when
the Muslim woman went to the restaurant to have dinner with her son.
Footage obtained during the incident shows the mother
and son arriving at the restaurant door, and the woman who owns the business
said she will not let the two customers into the restaurant because her mother
is wearing a "headscarf from the Dark Ages."
The restaurant owner, who is believed to be a
Christian because she was wearing a religious symbol – a cross around her neck
– claimed that "the headscarf is a tool to subdue women" to her
Muslim client, whom she then refused to let in.
The customer, who stated that he was shocked by the
words directed at him, went to the police station and filed a complaint on the
grounds that they were discriminated against.
With the implementation of laws targeting Muslims in
France, Islamophobic and discriminatory attacks against headscarved women,
Muslims and Islamic establishments and places of worship have increased, which
appear to have emboldened anti-Muslim racist attacks.
Recently, the decision of the municipality of Grenoble
to allow veiled swimwear on public beaches and swimming pools in the country
was suspended by a court upon the instructions of Interior Minister Gerald
Darmanin.

Pakistan: Officials, rights activists honoured for
their role to end violence against women

ISLAMABAD: Women’s right to live a life free of
violence and abuse outside and inside their homes is constantly under threat.
However, it goes to the credit of the rights activists
and because of the government’s proactive policies, laws and their effective
implementation both at the federal and the provincial levels, there is an
increasing awareness in society about violation of women’s rights.
Speakers expressed these views while addressing an
award-giving ceremony titled ‘2021 in Retrospective – Celebrating Action to End
Violence Against Women’ held at the Swedish ambassador’s residence.
The Embassy of Sweden and United Nations (UN) Women
Pakistan jointly hosted the event that was attended by the parliamentarians,
ambassadors, diplomats and members of civil society.
The ceremony was held to appreciate the commitments
and actions taken on pledges made in 2021, under the global theme of ‘Orange
the World: End Violence against Women Now!’
A menace that knows no boundaries
Ambassador of Sweden Henrik Persson in his welcome
remarks held that Sweden and the UN Women shared fundamental commitments
towards gender equality. Violence against women and girls is the most pervasive
human rights violation around the world. It has no social or economic borders
and no country is saved from this menace as it affects the rich and the poor
alike.
UN Women’s Country Representative Sharmeela Rasool and
Sweden’s First Secretary Lotta Segerström Tejpar narrated stories of the
victims of violence while UN Women Goodwill Ambassador Muniba Mazari recited a
poem which she dedicated to all men and women striving to end gender-based
violence.
Steps underway to end discrimination in GB
Chief Minister of Gilgit Baltistan (GB) Khalid
Khurshid Khan, who was the chief guest at the ceremony, spoke about the
situation in his province. “In some of our districts we have achieved more than
95 per cent female literacy rate but in others, it is as low as 6 per cent,” he
said.
“We have to cover a long distance to achieve the goal
of zero-discrimination against women, he admitted adding, the GB government was
in collaboration with various institutions to set up a nursing institute in the
province as at present there was none. We are taking steps to mainstream women
and girls in socio-economic and political life so that they do not remain
silent when they face any type of violence,” he said.
Law enacted against harassment at workplace
Chairman of the Senate’s Standing Committee on Human
Rights (HR) Senator Walid Iqbal encouraged stakeholders to make commitments on
ending violence against women and briefed them on the successful passage of
bill against harassment at workplace earlier this year in January.
Later, awards were given to the officials and
representatives from the Punjab, Khyber Pakhtunkhwa (KP), Balochistan and the
Islamabad Capital Territory (ICT).
