A Woman Doctor from Karnataka Moves SC for Declaring 'Talaq-e-Kinaya' and 'Talaq-e-Bain' As Void

Supreme Court of India

----

OCT 03 2022

A woman doctor from Karnataka has approached the Supreme Court seeking a declaration that all forms of unilateral and extra-judicial Talaq including 'Talaq-e-Kinaya' and 'Talaq-e-Bain' as void and unconstitutional.

In a plea, she contended the practices are arbitrary, irrational and contrary to In a writ petition filed through advocate Anantha Narayana M G, the petitioner, who completed MS in Obstetrics and Gynaecology from Karnataka, claimed that she suffered mental, verbal, physical and financial abuse and harassment from her doctor husband and his family for dowry soon after her marriage on October 20, 2020.

After a brutal assault in September last year, the woman, who hailed from Kalaburgi, claimed she remained hospitalised for about 10 days. Thereafter, her husband dumped her.

In January 2022, a pre-filled letter from 'kazi' office arrived containing eight to 10 generalised and vague allegations. With this, it was stated on her husband's behalf that due to all these conditions, it is not possible to continue this relation and she is relieved of matrimonial relationship, her plea claimed.

"These words are called Kinaya words (ambiguous words or unclear form e. g. I free you, you are free now, you/this relation is haram on me, you are separated from me now, etc ) through which Talaq-e- Kinaya/Talaq-e-Bain (instantaneous and irrevocable and extra-judicial form of Talaq, in single sitting, either pronounced or in written/electronic form) is given," the plea claimed.

It was alleged Talaq-e-Bain is used as a means for instant divorce.

The woman claimed she tried mediation but her husband refused to participate, forcing her to lodge an FIR on August 19, 2022.

In her plea, she sought a declaration that Section 2 of the Muslim Personal Law (Shariat) Application She also asked the court declare the Dissolution of Muslim Marriages Act, 1939, void and unconstitutional for being violative of Articles 14, 15, 21, 25 of the Constitution in so far as it fails to secure for Muslim women from such unilateral and extra judicial talaq.

She claimed such unilateral divorce has profound consequences on the quality of justice rendered in the country as well as ensuring a life of dignity guaranteed by Part-III of the Constitution.

Tiina Jauhiainen, Finnish Women's Rights Activist to Sue UAE Govt over Torture, Ordeal in Prison

03 October 2022

A Finnish women's rights activist has recounted her suffering during her detention in the United Arab Emirates (UAE), saying she will take legal actions against the Emirati government for her imprisonment and torture.

According to the Emirates Leaks, Tiina Jauhiainen plans to draw the international community’s attention to the gross human rights violations being committed in the Persian Gulf country.

Jauhiainen announced in a meeting held in the Swiss city of Geneva last week that she was not going to remain silent in the face of what she went through during her time behind bars and that she intended to take legal measures in European courts of law and sue the UAE for her torture.

During the event, she said Emirati security forces incarcerated her in an unknown and extremely cold place, repeatedly threatened her with death, and forced her to write confessions and sign official papers in Arabic.

Jauhiainen used to reside in the United Arab Emirates. She was arrested and tortured for participating in the failed attempt of Princess Latifa, the daughter of UAE Prime Minister Sheikh Mohammad bin Rashid Al Maktoum, to escape from her father in 2018.

The Finnish activist then addressed the British women, saying, “I want to advise you to think twice before traveling to the UAE and never be fooled by the image of a [so-called] safe and tolerant society that some are trying to portray [of the country].”

Back in March 2020, female Emirati prisoner Maryam al-Balushi attempted suicide at a detention center in the UAE by cutting a vein in her arm, months after she reported being subjected to various forms of torture and threatened with rape.

The International Campaign for Freedom in the UAE (ICFUAE) said in a statement at the time that Balushi carried out the suicide at al-Wathba Prison, just outside the capital Abu Dhabi, due to the deterioration of her psychological state after being threatened by the public prosecution office as she refused to record confessions to be published via official channels.

Balushi was arrested on November 19, 2015 and was charged with financing “terrorism” after donating money to a Syrian family. She insists the donation was done in good faith, according to the ICFUAE.

Human rights sources, requesting not to be named, also revealed that Balushi had been denied medical treatment over months for liver cirrhosis and kidney stones.

The UAE authorities similarly denied care to another female detainee, identified as Amina al-Abdouli, who suffers from anemia and liver disease.

In May 2019, female detainee Alia Abdel Nour passed away from cancer after being denied access to urgent medical care by prison officials.

An Italian woman is among foreigners held in Iran: Report

03 October, 2022

A young Italian woman traveling in Iran was arrested, and jailed in Tehran, a newspaper reported on Monday, days after authorities there said nine foreigners had been held over nationwide protests.

The parents of Alessia Piperno, 30, from Rome, said they lost contact after speaking to her on Wednesday – her birthday – but then received a phone call on Sunday morning to say she was in jail.

“They arrested me. I am in a prison in Tehran. Please help me,” she told them, according to Il Messaggero, Rome’s daily newspaper.

The added: “I’m fine but there are people here who say they have been inside for months and for no reason. I fear I won’t be let out again. Help me.”

At least 92 people have been killed in crackdowns on women-led protests sparked by the death of 22-year-old Mahsa Amini after her arrest by the notorious morality police, the group Iran Human Rights said on Sunday.

Iran has accused outside forces of stoking the nationwide protests, especially the US and Washington’s allies, and on Friday the intelligence ministry said nine foreign nationals – including from France, Germany, Italy, the Netherlands and Poland – had been arrested.

Italy’s foreign ministry has so far made no comment on the identity of the Italian held and did not respond to further requests on Monday about Piperno’s status.

Amnesty Italy tweeted that it hoped the foreign ministry in Rome would do “everything it can” to obtain Piperno’s release.

Her father, Alberto, said that when he spoke to her on Wednesday, she had been planning a birthday picnic with friends from France, Poland and Iran.

Piperno has been travelling the world for the last six years, according to her Instagram account, and had been in Iran for two months, according to the newspaper.

'The system failed to protect us': Moroccan women outraged at mass sex assault at L'Boulevard Rap festival

Basma El Atti

Rabat

03 October, 2022

"I still feel their bodies pushing against mine," Salma, a Moroccan 20-year-old student who witnessed last's week mass sexual assault at Casablanca's L'Boulevard Festival last Friday, described to The New Arab.

Late on Friday, amid a much-awaited free performance of Morocco's A-list rappers, tens of armed young men attacked the tens of thousands of audience members at RUC Stadium in Casablanca.

In a purge-like scenario, the "gang" attacked the audience randomly using belts, knives and batons. The chaos intensified as people started pushing toward the closed exits.

"If you fell you were dead; everyone was trying to save their lives," Mohsin, a 22-year-old Moroccan student, said to The New Arab.

The chaos lasted for nearly two hours before people were evacuated said witnesses.

Several accounts of sexual assault and attempts of rape flooded social media, as the Moroccan public watched in shock.

"They were trying to sexually assault me. When my friend tried to stop them they started beating him badly," Salma added in her statement to The New Arab.

During the first minutes of the chaos, rappers carried out their performances unaware of what was happening to the audience.

The events ended with no fatalities, but with several injuries and hundreds of traumatising stories by women who experienced sexual assaults.

L'Boulevard team has issued an apology on its social media pages and condemned "the vandalism acts, which do not honour the spirit of the festival,". They promised an investigation into the sexual assault allegations.

However,  despite Friday's events, L'boulevard decided to continue its shows during the weekend, a step widely criticised.

Meanwhile, Casablanca's police denied Monday the sexual assault allegations, saying, "no rape case was registred at the city's hospitals or police stations."

They also announced that twenty were arrested at the festival for "drinking alcohol in public, using drugs, and theft." Only two of the arrested were charged with "beating and injuring."

The investigation is still ongoing, according to the police's statement.

As many questions remain unanswered about what happened that Friday, the Moroccan public blamed the events mainly on lack of security and the misogynist mentality prompted by the sexist lyrics in rap songs.

Friday's tragedy also returned the spotlight to women's safety in public places in Morocco.

Many Moroccan women took to social media to voice the terror they experience when attending festivals, going out at night, or just by "living in Morocco."

"People have been raped, sexually abused, brutally injured (broken bones, permanent loss of sight and literal body parts) valuables stolen… you can blame the perpetrators all you want but this is also a matter of national security because once again the system failed to protect us," tweeted a Moroccan social media user.

Moroccan outlaws and 7achak, two leading Moroccan digital feminists platforms, have started gathering statements from Friday's victims and are pushing for a serious investigation.
